Under Chapter 7, your nonexempt assets are collected by a trustee who then reduces them to cash and distributes the funds to your creditors. Many debtors who choose to file Chapter 7 receive a discharge that releases them from personal liability for certain dischargeable debts.

Chapter 13 Bankruptcy

Chapter 13 bankruptcy is usually filed by people who have a regular source of income, want to pay off their debts, but are currently unable to do so. Under Chapter 13 bankruptcy, you are usually allowed to keep your valuable assets. This makes Chapter 13 more preferable for some people than Chapter 7 bankruptcy.

If you want to file for Chapter 13, you will need to propose a repayment plan to the Court that shows how your creditors will be repaid over time. If the Court approves your plan, you will make payments to the creditors through a trustee.
